Claims, claims everywhere with more standing in the line seem to be the pathetic state of the Employment Tribunal. The number of disgruntled employees has risen with many claims still pending at the Employment Tribunal.
Employment Lawyers are a concerned lot and not very sure about the future. With claims pending and quality of services dismal, the Tribunal is taking a beating not only in terms of efficiency but also in terms of reputation. The once highly regarded Tribunal is being scoffed at for poor quality services, inadequate procedures, inefficient staff and inconsistency.
ELA has suggested some remedial measures in the wake of a survey conducted. The results of the survey are astonishing with over 90% of the survey respondents believing that the judiciary has to be more consistent in terms of approach to practice and procedure. Over 80% of the respondents clearly declared that the Employment Tribunal had become highly inconsistent in its practices and about 55% of respondents were clearly not satisfied with the quality of the services received.
The ELA has now put forth a series of measures aimed at consistency and quality. As the number of claims has increased, the system has not been able to handle the cases with equal efficiency. It has resulted in additional stress and it is time to get going with some new action aimed at resolving the problem.
According to Joanne Owers, Chair of ELA, who is chairman of ELA’s working party on the tribunals service, employment tribunals are under immense pressure and that has resulted in inefficient service. In fact, the number of claims has risen by over 50% in the last year. This is a jolt in the arm as the resources available with the Tribunal have remained constant.
In a make do with it attitude, the Tribunal has ended up in a sorry state. It is now time to implement suggestions by the ELA for a better tomorrow.

The fire was reported only after it had reached the second floor of the building when it was spotted by a worker in the adjacent building. The fire disaster was a serious breach under the provisions of Regulatory Reform (Fire Safety) Order 2005 (the RRO).
The judge HHJ Revlin ordered New Look to pay a fine of £400,000 for fire safety breaches and an additional £136,052 in costs. This was a record in the history of large fines and New Look was devastated.
It appealed to the Court that the sentence was harsh. It argued that the fire safety systems were in place. It also argued that there was no loss of life or serious injuries. It appealed that the fines were huge and justice not served. However, the Court of Appeal did not find the argument reasonable as fire safety breach is a serious threat.
It upheld the judge’s sentence and reiterated that the court did not require loss of life or serious injuries to take matters of public safety seriously. New Look learnt the bitter lesson.

Unite believes that the staff that are required to put in a residential stay during their shifts at work, also known as ’sleep-ins’, are actually being deprived of their NMWs for that period. It says that if the employee is expected to work or can be called by the employer for emergency, this should be treated as working time under the Working Time Regulations 1998.
National Officer, Not for Profit Sector, Rachael Maskell pointed out the case laws that provide for applicability of NMW laws for employees working such shifts. However, many employers ignore the laws and fail to pay the current National Minimum Wage of £5.80 an hour for the sleep over. She also added that the employees could bring an action for malicious or illegal wage cut in such cases.
She pointed out a Scottish mental health charity that had failed to pay the NMW to employees, who were asked to sleep over and tend to patients even at night. Instead of paying them the minimum wage, the charity paid them some allowances or gave them some time off.

A construction firm was recently found guilty of negligence at the workplace resulting in injury to an employee, who was trapped in a collapsed trench for two hours.
The firm, Vickers Construction Limited, of Yarm Road, Eaglescliffe was fined £5,000 along with costs of £3,178.10 by Darlington Magistrates’ Court after it pleaded guilty to the charges of violation of Section 2(1) of the Health and Safety at Work etc Act 1974.

A subsequent investigation into the case by the HSE disclosed that the driver of the said excavator had not received proper training for the job. HSE Inspector, Dr Dave Shallow said that trench collapses are one of the common reasons for grave injuries and deaths in construction business, though most of the accidents are preventable if safety measures are adhered to. He also pointed out that an excavator drivers should be given proper training and appropriate equipments including trench boxes and shoring should be provided to ensure worker safety. He added that companies need to realize the risks involved in excavations and implement adequate safety measures at the workplace before starting work.
It is worth noting that the first case dealing with such instances under the new Corporate Manslaughter Act, which is presently adjourned, also involved an employee who was working in an excavation pit that collapsed, resulting in his death.
